Terms of Service:

1.) Account Setup/Project Start Time

We will setup your account for Hosting clients automatically and send you via e-mail a welcome packet after payment is made as agreed upon on chosen plan options.Projects require a minimum 25% non-refundable down payment, this is required prior to start of project. Marketing Services are required to have the setup fee and first month's payment made prior to starting. All printing services must be paid in full before we start and are considered custom and therefore non-refundable.IT Services/Computer repair/Networking are due at time of service. All other services are to be considered under the same policies as Projects, unless otherwise agreed upon, in a written documented contract. Late fees may apply on any reoccurring accounts that are not paid on time. We reserve the right to use our discretion in terms of when to charge additional fees for late payments,etc.

2.) Content


Using a shared account as a backup/storage device is not permitted, with the exception of one cPanel backup of the same account. Please do not take backups of your backups. Examples of unacceptable material on all servers include: Topsites IRC Scripts/Bots Proxy Scripts/Anonymizers Pirated Software/Warez Image Hosting Scripts (similar to Photobucket or Tinypic) AutoSurf/PTC/PTS/PPC sites IP Scanners Bruteforce Programs/Scripts/Applications Mail Bombers/Spam Scripts Banner-Ad services (commercial banner ad rotation) File Dump/Mirror Scripts (similar to rapidshare) Commercial Audio Streaming (more than one or two streams) Escrow/Bank Debentures High-Yield Interest Programs (HYIP) or Related Sites Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme) Sale of any controlled substance without prior proof of appropriate permit(s) Prime Banks Programs Lottery Sites MUDs/RPGs/PPBGs Hateful/Racist/Harassment/discrimination,or otherwise hurtful to another, oriented sites Hacker focused sites/archives/programs Sites promoting illegal activities Forums and/or websites that distribute or link to warez/pirated/illegal content Bank Debentures/Bank Debenture Trading Programs Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com) IRC Scripts/Bots Pirated Software/Warez IP Scanners Bruteforce Programs/Scripts/Applications Mail Bombers/spam Scripts Escrow High-Yield Interest Programs (HYIP) or Related Sites Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme) Sale of any controlled substance without prior proof of appropriate permit(s) Prime Banks Programs Lottery Sites CWTEnterprises services, including all related equipment, networks and network devices are provided only for authorized customer use. CWTEnterprises systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of CWTEnterprises system(s) constitutes consent to monitoring for these purposes. We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice. Our goal is to offer safe, cost effective, secure, stable Hosting environments, and otherwise provide excellent services. We cannot allow anything that may prevent our company from achieving the best service for the rest of our clients. Failure to respond to email from our support department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via trouble ticket/email and will have a response within 48 hours. Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography: Any site found to host child pornography or linking to child pornography will be suspended immediately without notice. Violations will be reported to the appropriate law enforcement agency. It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

3.) Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt in" will be treated as spam. Any user who sends out spam will have their account terminated or suspended with or without notice. They may also be required to pay a fine. This will be based on the situation case by case, the amount of damages, actual or implied, including loss of time, overall scope of issue, etc are factors on if fines will be access and if so how much is acceptable.
We reserve the right to require changes or disable as necessary any web site, account, database or other component that does not comply with this policy, at our and the terms of services' sole discretion. We also reserve the right to make any such modifications in an emergency at our sole discretion.
We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of CWTEnterprises.com All rights reserved.

These lists of laws and content policies, and statments is not to be considered all inclusive and CWTEnterprises.com may, at it's discretion,may have to take action as we see fit, should a situation occur that needs to be addressed. To be able to have an all inclusive list would be practically impossible, as new situations, or previously not mentioned situations are created. We appreciate your understanding and your desire to help insure we can continue providing our clients with excellent service.

4.) Payment Information

You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify CWTEnterprises.com of your desire to cancel any or all services received, those services will be billed on a recurring basis, for monthly payment services, ex. Hosting or Marketing Packages,etc. We only accept Amex, Discover, Master card ,Pay pal or Visa payments. No checks, travelers checks, money orders, western union, cashier checks, etc will be accepted. We reserve the right to change the monthly payment amount and any other charges at anytime, as deemed needed due to unforeseen occurrences/issues,etc. We will notify you accordingly as needed if this situation arises.

5.) Backups and Data Loss

Your use of any services provided by CWTEnterprises.com,affiliates,partners,3rdparty companies,etc is very much at your sole risk! We are not responsible for files and data residing on your account. We are unable to control all aspects of the Internet,or computers, and unforeseen events, that we can not be held accountable for may arise. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers. For networking jobs you agree that we are not responsible for equipment loss, data loss, loss of time or any other loss whatsoever. CWTEnterprises.com is not liable for any loss,of any kind at anytime for any reason at all ever.

6.) Cancellation and Refunds

We do not offer any refunds on any services,as everything we do is considered custom,unique to our clients need, etc. First time hosting clients within the first 15 days are the only exception to this rule. They may receive a pro-rated refund based on days of use, and we do reserve the right to charge even in first 15 days, if excessive Bandwidth usage occurs, or other violations of this TOS,etc. We will work very hard with you to resolve any potential issues to insure complete satisfaction.

7.) Resource Usage

Users may not initiate the following:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: Bad CGI scripts, FTP, PHP, HTTP, etc.
b) Run any type of interactive real-time chat applications that require server resources. That have not been pre approved. Remotely-hosted services are fully allowed.
c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
f) Use resources in excess, even on unlimited accounts, that causes difficulties,or is not normal resource usages.
G) Anything else deemed unacceptable use of resources, even on unlimited accounts.

8.) Bandwidth/Data Transfer Usage

You are allocated a monthly bandwidth allowance, or an unlimited allowance. This allowance varies depending on the hosting package you purchased. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month. If you see you are getting close to maxing out your bandwidth please contact us right away. Many times we can help, without additional fees, and our goal is to fully help and insure satisfaction without extra bandwidth fees. Please do not wait for us to have to suspend the account. Suspensions are not good for your Clients, You or Us. Unlimited accounts are not allowed to use Bandwidth/Data Transfer excessively. Unlimited is a term used for our purposes,intending on allowing customers will normal sites to have as much customer, visitor flow as needed without paying huge bandwidth overages. We are not intending, or allowing customers to run high bandwidth intensive sites, with video streaming,or other bandwidth intense programs, scripts etc. We reserve the right to discuss and determine with our clients what is and what is not considered acceptable unlimited bandwidth utilization, and usage amounts, if needed. We also reserve the right to suspend any sites regardless of bandwidth allocation due to anything we may consider to be a violation of this policy. Again we strive to insure all clients have an enjoyable experience and sites that engage in Bandwidth hogging, or otherwise wrong uses of Bandwidth make experiences worse for all parties involved.

9.) Price Change

The amount you pay for hosting/Marketing, etc will never increase from the date of purchase when purchasing packaged amount of time, ex 3mth,1yr,2yr,etc. Month to Month plans may change if we need to and if proper notification is provided to the affected client. We strive to control our costs and insure prices stay the same, but sometimes unforeseen issues force price/package adjustments. We reserve the right to change prices listed on our site, and the right to increase the amount of resources given to plans/packages/services at any time as we see fit.

10.) Indemnification

Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from CWTEnterprises.com's server.

11.) Disclaimer

We will not be responsible for any damages yourself or your business,or other individuals,may suffer from anything. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes, but is not at all limited to, loss of data resulting from delays, no deliveries, wrong delivery and any and all service interruptions caused by us and or our employees, or any other kind of loss. Unforeseen events are possible as we do not control the Internet, or computers, and anything is possible. The client is held solely responsible under any and all circumstances. CWTEnterprises.com is not liable for anything at anytime, under any circumstances.

12.) Changes to the TOS

We reserve the right to revise its policies at any time without notice.
